Welcome to Noland Art Studio (“we,” “us,” or “our”). By engaging with our freelance art services, you agree to these Terms and Conditions. Please read them carefully.

2. Services Provided

We offer freelance art services including, but not limited to, custom artwork, illustrations, graphic design, and other related services as detailed on our website or in our communications with you.

3. Acceptance of Terms

By placing an order or engaging our services, you agree to these Terms and Conditions. If you do not agree, please do not use our services.

4. Ordering and Payment

a. Ordering:

• To place an order, please provide detailed instructions and any necessary materials required for the artwork.
• We reserve the right to refuse service for any reason.

b. Payment:

• Payment is due before the start of work unless otherwise agreed upon.
• We accept payments via [accepted payment methods, e.g., credit card, PayPal].
• Prices for services are as stated on our website or as quoted in our communications.

5. Revisions and Deliverables

a. Revisions:

• We offer 4 revisions per project. Additional revisions may incur extra charges.
• Revisions must be requested within 1 week after receiving the initial draft.

b. Deliverables:

• Final artwork will be delivered in the format(s) agreed upon.
• Delivery timelines will be provided upon project initiation but are subject to change based on complexity and workload.

6. Intellectual Property

a. Ownership:

• Upon full payment, you will receive the rights to use the final artwork for personal or commercial purposes as specified in the project agreement.
• We retain the right to use the artwork for portfolio and promotional purposes unless otherwise agreed upon.

b. Copyright:

• Copyright for the artwork remains with us unless transferred as part of the project agreement.

7. Cancellation and Refunds

a. Cancellation:

• You may cancel your order before work begins. Any payments made may be refunded subject to a cancellation fee of 10%.
• Once work has commenced, cancellations may not be accepted, and no refunds will be provided.

b. Refunds:

• Refunds are only issued if we fail to deliver the services as agreed upon. Partial refunds may be provided if work is partially completed.

8. Client Responsibilities

• Provide clear and complete instructions and materials for the project.
• Respond promptly to communications and provide feedback in a timely manner.

9. Liability

• We are not liable for any indirect, incidental, or consequential damages arising from the use of our services.
• Our total liability for any claim related to our services is limited to the amount paid by you for those services.

10. Privacy

11. Termination

We reserve the right to terminate the agreement if you breach these Terms and Conditions. Upon termination, you will be liable for payment for any work completed up to the date of termination.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Washington state. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts located in Washington state.
